I highly recommend the firm if you have any family law needs.

Kiana represented me in my divorce and was fantastic. She’s tough when she needs to be, but is also easily approachable and capable of navigating very sensitive issues. There were some complicated issues in my divorce and I was impressed at her knowledge of the law and ability to explain it to me in simple terms. I highly recommend the firm if you have any family law needs.

I cannot say enough positive things about Adam Neufer or the support and service he provided during one of the most challenging times in my life.

He was professional, prepared, and present while offering a personal touch during matters of sensitivity and distress. Although he was juggling numerous other cases, I always (yes, always) felt like Adam prioritized me and my situation. He was easy to communicate with and prompt about responding to both calls and emails. No matter how many questions I had, Adam took the time to answer them with thoughtfulness and care. I felt well-represented in the court room and appreciated the tone Adam maintained with judges, opposing attorneys, and his own staff. I emphatically recommend his services to anyone dealing with custody issues and beyond. Adam made an excruciating experience bearable; I am grateful that he was recommended to and represented me during this time.

Where to File for a Military Divorce?

Choosing where to file for divorce is the first aspect of military divorce that diverges from a typical divorce, where jurisdiction is in the state and county where at least one spouse has resided for six months. Military members are often the legal residents of one state while residing in another or deployed overseas. Military spouses may file for divorce in the state where the non-military spouse resides or in the state where the military spouse is stationed. When a civilian spouse files for divorce from a deployed service member, they must contact the Hague Office to ensure the divorce petition is served to the deployed spouse overseas.

Your military divorce lawyer from Moradi Neufer Family Law Attorneys will advise you on meeting the jurisdiction requirements for your military divorce and facilitate the process of serving a deployed spouse. The law allows active duty service members extended time to respond to a divorce petition while deployed through the Service Members Civil Relief Act (SCRA). In some cases, divorce papers are not served to a spouse until after they’ve completed a mission to avoid distracting them during duty.

Child Custody and Child Support in Irvine Military Divorces

There are important considerations for child custody in divorced military families. When one parent faces frequent deployments, traditional child custody schedules are not possible. California has legal protections in place for military parents so changes to the custody schedule are temporary and limited to deployment periods. The court may also allow reasonable visitation rights to a close relative of the deployed parent such as the child’s grandparent. Protections also extend to child support by limiting the amount of child support paid by the deployed parent to prevent an unreasonable amount resulting from the state’s formula. Typically, the fewer custody days a parent has, the greater the amount of child support they pay to the other parent, but this quickly becomes unfair to an active duty service member with limited custody days due to deployment.

Division of Assets and Retirement in Military Divorce in Irvine

California’s divorce law requires divorcing spouses to equally divide their marital assets, including retirement accounts. A military spouse’s entitlement to a portion of their spouse’s military pension depends on a formula based on the duration of the marriage.
